BEAVER DAM RESORT, LLC, MANKATO, MN (APPLICANT); ANDY BUYSEE & BRENT BUYSEE, CLEVELAND, MN AND CHUCK FENGER & BRIAN TIMM, SANBORN, MN (OWNER):

Request that the County grant a Variance from the Le Sueur County Zoning Ordinance to allow the applicant to reduce the required setback from the Ordinary High Water Level (OHWL) of German Lake from 100 feet to 16 feet to accommodate a commercial deck; reduce the required setback from the Ordinary High Water Level (OHWL) of German lake from 100 feet to 36 feet to accommodate an existing fish cleaning structure; and to increase the number of allowed boat slips from 21 to 34 in a Recreational Commercial “RC” Shoreland District, German Lake, a Recreational Development “RD” lake.  Property is located in Part of Outlot 2, Auditor’s Subdivision, Part of GL 1, Section 5, Township 109, Range 24 and Beaver Dam Plat, Lot 1, Block 4, Elysian Township. VARIANCE IS FOR OWHL setbacks and number of allowed boat slips.

Request that the County grant a Variance from the Le Sueur County Zoning Ordinance to allow the applicant to reduce the required setback from the road Right-Of-Way (ROW) from 65 feet to 11 feet; reduce Ordinary High Water Level (OHWL) setback from 100 feet to 30 feet, and 33.3% total impervious surface coverage of the lot to accommodate the construction of a replacement of a single family dwelling in a Recreational Residential “RR” Shoreland District, Lake Washington, a Recreational Development “RD” lake.  Property is located in the Baker Bay Subdivision, Lot 37, Section 12, Kasota Township.  VARIANCE IS FOR ROAD ROW AND OHWL SETBACKS AND IMPERVIOUS SURFACE.

Board of Adjustment Hearing Procedure:  The Chairman calls the meeting to order, then calls the item to be heard and asks the Applicant or representative present to come to the podium to answer any questions or present any comments.  The Chairman opens the meeting to the public.  Each speaker comes to the podium and states their name for the record prior to making a statement or posing a question.  All questions or comments are to be directed to the board, not the applicant.  After the public comments the Board of Adjustment publicly discusses the information and reviews the findings before making a motion.  All meetings are recorded.
